Article 73(1&2) lands Trans Nzoia Employment Board in Trouble.

    The Trans Nzoia County Public Service Board Chairman Mr. Wilson Siambi will land in Court after contravening the code of conduct as a government officer.

    Mr.Siambi and his team have violated the 2010 Kenyan Constitutions while on duty to serve the public and have been chest thumbing. The county government of Trans Nzoia advertised reinforcement jobs on the Standard newspaper dated 5/2/2019, surprisingly the County Public Service Board has gone ahead without following the due process and has employed a 100 Boda bodas who are moving in town with rugu’s.

    The Trans Nzoia Workers Union Chairman Samuel Kiboi with his team have vowed to take the matter in Court for Mr. Siambi to explain why he went against the Constitution as a government officer who should serve the public without representing or showing personal interests.

    Mr.Kiboi said the government procedure it’s that after advertisement, short listing should take place followed by interview but the CPSB has taken shortcut to employee their own people thus causing public injury Constitutionally where government funds were injected in the advertisement that ‘’bosses” had already made decisions whom to employee.

    Kiboi says the Board Chairman one Mr. Siambi will carry the cross for others following the Board misconduct, Article 73 (1) a & b (2) a, b & c of the 2010 Kenyan Constitutions’ states that;

    (1) Authority assigned to a State officer–

    (a) is a public trust to be exercised in a manner that–

    (i) is consistent with the purposes and objects of this Constitution;
    (ii) demonstrates respect for the people;
    (iii) brings honour to the nation and dignity to the office; and
    (iv) promotes public confidence in the integrity of the office; and

    (b) vests in the State officer the responsibility to serve the people, rather than the power to rule them.

    (2) The guiding principles of leadership and integrity include–

     (b) objectivity and impartiality in decision making, and in ensuring that decisions are not influenced by nepotism, favouritism, other improper motives or corrupt practices;
    (c) selfless service based solely on the public interest, demonstrated by–

    (i) honesty in the execution of public duties;
    (ii) the declaration of any personal interest that may conflict with public duties;

    (d) accountability to the public for decisions and actions;and
    (e) discipline and commitment in service to the people.

    Kiboi said the County Public Service Board has also contravened Article 75(1) that says; A State officer shall behave, whether in public and official life, in private life, or in association with other persons, in a manner that avoids–

    (a) any conflict between personal interests and public or official duties;
    (b) compromising any public or official interest in favors of a personal interest; or
    (c) demeaning the office the officer holds.

    Apart from quoting more Articles, Kiboi said the Union would invite the EACC to step in as interested parties in their case to nail some individuals who have turned the public office into private instead of serving the public as required by the law.

    He further revealed how 21 accountants whom were employed by the same board have not received their salary for some months since they were given appointment letters’’ we shall use the same letters to take him to Court if he thinks that’s a private office’’ paused Kiboi.

    When questioned by the press if the Union can step down if employment issue is ironed out, Kiboi said the Union has no problem for dialogue if only employment grievances are solved forever. He said casual workers are 790 proposing if those below 45 years can be absorbed permanently and the rest their contract be renewed the Union will accept the offer. He added that some casual jobs like cleaning do not require papers.

    ‘Our problem as Union, employ those inside first before outsourcing of staffs with no experience and am not fighting anybody but the rights of workers and defending the Constitutions,we have enough evidence” Kiboi told the press.

    Kiboi said jobless Trans Nzoia people should benefit from the jobs advertised in a transparency manner.
